This is a new legal approach which many couples find to be a more constructive approach than traditional court proceedings
In the collaborative divorce process the solicitors involved in the case and their clients agree to reach settlement without involving the courts through a series of face to face meetings, with parties agreeing to give full disclosure of their financial circumstances within the process
If settlement is reached the collaborative lawyers on each side will deal with the divorce and the recording of any consent order to finalise matters. Only approved collaborative lawyers can sign collaboration agreements. If a settlement cannot be reached, new lawyers must be instructed to issue court proceedings.
By maintaining an amicable dialogue between parties the legal process is speeded up and unnecessary costs and disputes avoided.
