Constructive Dismissal

If your employers actions have left you with no choice but to leave your job you may be able to claim that you have been constructively dismissed.

Actions which might justify your leaving include situations where your employer has made unreasonable amendments to your contract of employment or where you have been subjected to illegal working conditions or other unreasonable actions.

Its important that you first follow your employers grievance procedure but if this does not resolve the issue and the breach is a fundamental breach of your contract of employment you are entitled to leave the job without notice and this will be treated as if you had been dismissed by your employer.

This is a complex area of law and it is vital that you take early advice from one of our experts before leaving your employment.

If you have been constructively dismissed you have the right to bring a claim for compensation to an employment tribunal. Strict time limits apply so if you have been the victim of a constructive dismissal contact us now.
