Grievance Procedures
The law requires that you to tell your employees in writing who they should complain if they have a grievance about their employment. Additionally if you fail to have in place a proper procedure for dealing with their grievances this in itself can amount to constructive dismissal and leave you facing a hefty damages bill.
It’s good business sense to have a proper grievance procedure in place because it can nip disputes in the bud and stop them escalating into litigation, as well as defusing tensions at work and preventing valuable employees from leaving and productivity being affected by unhappiness.
ACAS guidelines lay down best practice and failure to follow this can lead to compensation awards being increased by up to 25% to penalise you for your non-compliance.
Rees Page can health check your existing procedures to make sure that they are up to date with the law and best practice. We can write a procedure tailored to the needs of your business if you do not have one or if yours is out of date. We can also advise on all aspects of how to deal with any grievances that you have received and how you can keep them from becoming tribunal claims.
