Separation
We understand that though a relationship may have come to an end there may be religious or practical reasons - such as the preservation of pension rights - why partners do not wish to divorce.
We advise in such circumstances that the parties take steps to agree the legal standing of the relationship by putting into place a deed of separation or in exceptional cases applying to the court for judicial separation.
Failing to take this simple step can leave room for future disputes over the payment of bills, the distribution of joint assets and how best to care for any children involved.
Where a couple have successfully agreed to a division of their family assets and the agreement has worked well for a period of two years or more, this could form the basis of a court order should the parties subsequently wish to divorce - saving both time and money.
